These Terms of Use govern your use of mallorcapoolbuilders.com. By using the Site or submitting your details, you agree to these terms. If you do not agree, please do not use the Site.
1. Who we are and what we do
Mallorca Pool Builders (“we”, “us”, “our”) operates an online introduction and lead-generation platform that connects property owners with independent, third-party pool builders and service providers in Mallorca (each a “Provider”). We act as an intermediary only.
2. What we do not do
We are not a pool builder, contractor or service provider. We do not design, build, renovate, repair, maintain, service or quote for pools, and we do not employ, control or supervise any Provider. “Vetted” describes our selection process only and is not a guarantee or endorsement.
3. Our service
When you submit an enquiry, request a quote, use the cost calculator or download a guide, you ask us to pass your details to one or more Providers so they can contact you, and we may send you information you have requested. We do not promise that any Provider will contact you, quote, be available, or be suitable.
4. Your contract is with the Provider, not us
Any quotation, agreement, contract, payment, work or service is concluded solely between you and the Provider. We are not a party to it and have no involvement in or responsibility for it. All rights, obligations, guarantees and remedies in respect of the work lie between you and the Provider.
5. No warranties
The Site and all its content are provided “as is” and “as available” without warranties of any kind. We do not warrant the accuracy or completeness of any content, or the availability, quality, safety, legality, licensing, insurance, pricing, qualifications, conduct or performance of any Provider. Cost calculator results and guide content are indicative estimates only, not quotations or professional advice.
6. Your responsibilities
Before engaging any Provider you are responsible for your own checks, including verifying the Provider’s identity, licences, permits, insurance, references and written contract terms, and for obtaining any permits required for your project. You agree to provide accurate information and to use the Site lawfully.
7. Limitation of liability
To the fullest extent permitted by law, we and our operators shall not be liable for any direct, indirect, incidental, consequential or special loss or damage, loss of profit, data or opportunity, or any loss arising from your use of the Site, reliance on its content, or any dealing, contract, dispute, defect, delay, damage or injury involving a Provider. Nothing in these terms excludes any liability that cannot lawfully be excluded, including your mandatory rights as a consumer under Spanish and EU law.
8. Indemnity
You agree to indemnify and hold harmless Mallorca Pool Builders and its operators from any claim, loss, cost or expense arising from your use of the Site, your breach of these terms, or any dealing or contract between you and a Provider.
9. Intellectual property and acceptable use
All content on the Site is owned by or licensed to us and may not be copied or reused without permission. You agree not to misuse the Site, attempt to disrupt it, or use it for any unlawful or fraudulent purpose.
10. Third-party links
The Site may link to third-party websites or content which we do not control and for which we accept no responsibility.
11. Changes
We may update the Site and these terms at any time. The version published here applies to your use of the Site, and continued use after changes constitutes acceptance.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Subject to any mandatory consumer rights, the parties submit to the courts of Palma de Mallorca, Balearic Islands, Spain.
13. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
